“What are you still doing here are you fucking dumb?”

The respondent is a 53 year old woman from Azerbaijan who is escaping from a violent situation of domestic abuse that has been lasting for many years. A situation that has actively put her life and the life of other in danger. She reached Bosnia with a Visa with the intention of going through Croatia, asking for asylum. She walked many hours from Lipa transition camp and attempted many times to access the legal crossing border between Bosnia and Herzegovina and Croatia near Izačić but was never allowed access to a Croatian officer. On the 10th of December 2025 she attempted once again together with a family with young children from Syria.

The respondent and the family was able to access the Croatian controlled territory of the border crossing and voiced their desire to ask for protection and asylum in Croatia. The Croatian border police was immediately aggressive and not listening to the requests, making sure to ignore the asylum request. After a few minutes the Syrian family was taken inside the Croatian Border police offices and possibly processed for asylum. On the other hand, the Azerbaijanian woman was left to wait in the cold as she tried to insist for her rights to be applied and explain what she was escaping from. She reports that the women police officers were particularly harsh to her and insulting and mocking or laughing at her. Some of the things said to her in that moment were: ” what are you still doing here? Are you fucking dumb?” “You are disgusting” After an hour of her waiting in the cold, she decided to get closer to a woman officer and talk to her. The respondent reports that she had her phone in her hand and wanted to show her documents and “proof” of the violence that she had been subjected to but the officer reacted aggressively and shouted in her face to stop recording. The interaction escalated from the side of the officer who then decided to break the respondents phone with the unlawful excuse of being recorded illegally in a border area. This clear destruction of property clearly constitutes unlawful interference and degrading treatment.
After this the respondent felt threatened and scared and was shouted at to leave. She had no other option than to leave and walk hours back to Lipa camp after having been victim of vile humiliation, destruction of property and the clear negation of her right to apply for asylum for a country, that is part of the European Union, in a legal way.
