“My birthday is on March 15th 2009”

The respondent is an unaccompanied minor who has arrived in Italy two weeks before the incident and intended to seek protection in France.

The unaccompanied minor took the train going to France/Menton on the 21st of January at 20:00h in Ventimiglia. In the train station of Menton-Garavan the border police boards the train and asks the minor to get off the train. The minor replies that his date of birth is “March XXth 2009” and that this is also stated on a paper he was given when arriving in Italy two weeks ago. He stated that he intends to stay in France and is asking for protection. The controlling police man is joined by two police colleagues. They arrest the minor and take him off the train without any further explanation. They refuse to speak to him and to answer his questions. He is brought to the border police station where he is put in a cell together with adults. As there are no covers in the cells and the temperature is freezing, the minor does not sleep all night and shivers when he is taken out of the cell and given a paper, an Arrêt, which states that his year of birth is 2007 and that he is hence readmitted to Italy.
On January 22nd 2026 the unaccompanied minor was released together with six other people at 10:00am in the morning. He is shivering and shaking. It takes about an hour before he begins to respond to questions and proposals.
